On October 16, 2013, the Government of Vietnam adopted Decree No. 131/2013/ND-CP on Sanctioning Administrative Violations of copyright and related rights (“Decree 131”) which replaces Decree 47/2009/ND-CP dated May 13, 2009, as amended and supplemented by Decree 109/2011/ND-CP dated December 2, 2011. Decree 131 will take effect as of December 15, 2013.
Decree 131 consists of 4 Chapters, 43 Articles featuring essentially the same content of the old above-mentioned Decrees 47/2009/ND-CP and 109/2011/ND-CP with some amendments and supplements with regards to acts of violation, monetary fines (one of the main regulatory sanctions), additional sanctions and other remedial measures, to be better in line with the new 2012 Law on Handling Administrative Violations. Given the importance of administrative measure in the IPR enforcement system of Vietnam, a Special Feature on Decree 131 will be published by D&N International in the near future on its website.
