The first domain name dispute brought to court settlement in Vietnam

The domain name dispute between the Plaintiff – Samsung Electronics Co., Ltd of Korea (“Samsung Company”) and the Defendants including a Vietnamese citizen and a Vietnamese company has finally been ended after more than one year in court proceeding by a judgment rendered by the Appellate Court of the Supreme People’s Court in Hanoi on March 29, 2011 on which Samsung Company’s appellate request to revoke the domain name samsungmobile.vn and give Samsung Company the priority in registration for use of this domain name has been accepted. The case is briefed as follows:

On October 21, 2009, Samsung Company represented by D&N International has initiated a lawsuit at Hanoi People’s Court against the registration and use in bad faith of the domain names samsungmobile.com.vn and samsungmobile.vn by a Vietnamese citizen and a Vietnamese company and requested the court to revoke these domain names and give Samsung Company the priority in registration for use of these domain names.

On June 2, 2011, the Court of First Instance under Hanoi People’s Court rendered a judgment to revoke the domain name samsungmobile.com.vn and give Samsung Company the priority in registration for use of this domain name. However, the Court of First Instance has dismissed Samsung Company’s request to revoke the domain name samsungmobile.vn.

Dissatisfied with a part of the Court of First Instance’s judgment, Samsung Company represented by D&N International has filed an appeal to the Appellate Court of the Supreme People’s Court in Hanoi. On March 29, 2011, the Appellate Court of the Supreme People’s Court in Hanoi rendered a judgment to accept Samsung Company’s appellate request to revoke the domain name samsungmobile.vn and give Samsung Company the priority in registration for use of this domain name.
