Law on Science, Technology and Innovation takes effect from October 1, 2025
From October 1st, 2025, the Law on Science, Technology and Innovation will take effect.
The Law on Science, Technology & Innovation was passed by the National Assembly on June 27, 2025. Considered a breakthrough in institutionalizing important resolutions of the Politburo on the development of science, technology & innovation as a foundation for the development of a knowledge-based economy, the Law on Science, Technology & Innovation is expected to remove administrative barriers to contribute to promoting the commercialization of scientific research results, promoting technology transfer and enhancing the protection of intellectual property rights.
In cases where a provision of the Law on Science, Technology and Innovation is different from that of other law or resolution of the National Assembly related to science, technology and innovation activities, the earlier shall apply, unless the later offers more preferential mechanisms/policies.
To carry out the State’s preferential policies for science, technology and innovation activities, Article 71 of the Law on Science, Technology and Innovation has amended, supplemented and abolished a number of relevant articles of 8 laws including: Law on High Technology, Law on Technology Transfer, Law on Personal Income Tax, Law on Land, Law on Press, Law on Construction, Law on Intellectual Property, Law on Housing, and Resolution No. 193/2025/QH15 of the National Assembly.
Regarding the Law on Intellectual Property, the most notable change is the complete abolition of regulations on the management of results of scientific and technological tasks using the state budget, such as regulations on the rights of the state, obligations of the organization presiding over the task, benefit sharing, registration rights, monitoring mechanisms… (specifically, the abolition of Articles 86a, Article 133a, Clause 2, Article 135, Article 136a, Clause 6, Article 139, Clause 3 and Clause 4, Article 164, Clause 2, Article 191, Article 191a, Article 191b, Clause 4, Article 194, supplemented by Law No. 07/2022/QH15, effective from January 1, 2023).
